NRAI has come across multiple media reports about CCI finding the “exclusivity” practise of online food aggregators as being anti-competitive.
To protect the business interests of our restaurant fraternity and to ensure a vibrant, fair and competitive environment for the thriving of all stakeholders, NRAI had filed a petition against Zomato and Swiggy before the CCI in September 2021.
A case for investigation was made out and our members have given their periodic inputs to the investigation arm of CCI.
We are in receipt of the redacted investigation report which was sent to us in March 2024 and we have reviewed the same.
However, in order to properly protect the interests of the market, we have petitioned the High Court very recently in November 2024 to request CCI to grant us access to the report in its entirety.
We remain committed to the cause while being in compliance of all laws and regulations of the country.
We would not comment on the findings of the DG Report since this is a confidential document.
Speaking on the subject, Sagar Daryani, the President of NRAI said, “NRAI has been consistently raising the issue of anti-competitive and predatory practices of the food delivery aggregators for last few years and today, we are glad to read in the news that supposedly CCI has found some merits in our contention. I hope that CCI will also speed up the investigation on the other issues raised by the NRAI in its petition in 2021”
Speaking further on the subject, he asserted that “We totally understand that the online business growth is an extremely important tool to grow the overall size of the sector and help India achieve the coveted target size of a $5 Trillion economy. However, it is imperative that the marketplaces like Swiggy and Zomato create a healthy and equitable market environment for the overall healthy growth within the sector”.
