The Delhi High Court has upheld the Municipal Corporation of Delhi’s decision to impose higher property tax rates on luxury hotels, ruling that the levy cannot be termed “arbitrary or capricious” given the clientele such establishments cater to.
Justice Purushaindra Kumar Kaurav, delivering the judgment on September 12, observed that luxury hotels voluntarily seek star accreditation, positioning themselves within a premium market that targets affluent guests and offers services at a higher price point.
“In light of this, the legislative intent underlying the imposition of elevated property tax rates on such establishments is to equitably distribute the fiscal burden, ensuring that those possessing greater capacity to pay contribute proportionately to the public revenue,” the court noted.
The verdict, uploaded on the High Court’s website on September 16, reinforces the principle that businesses serving high-income consumers can be required to shoulder a greater share of taxation, aligning with broader fiscal equity goals.
