Most hotels today work with several contractors for services like housekeeping, catering, and security. How does this make compliance management more complicated?
As businesses in India increasingly depend on contractors for functions ranging from housekeeping and logistics to IT and manufacturing, contractor compliance has emerged as a major challenge. Hotels, specifically, rely heavily on contractors for day-to-day operations. Each contractor brings its own workforce, licenses, registrations, wage processes and other statutory obligations. Under laws such as the Contract Labour (Regulation and Abolition) Act, 1970, the EPF Act, 1952 and the ESI Act, 1948, principal employers remain liable for lapses. If a contractor fails to pay wages, deposit provident fund or ESI contributions, or provide mandated benefits, the responsibility may rest with the contractor, but the liability ultimately extends to the principal employer as well.
The complexity grows with scale. Large hotels may engage dozens of contractors across locations, each with obligations covering challans, returns, registers, licenses and registrations under multiple Acts. Tracking these obligations manually through registers, reports and audits often leads to delays and gaps, leaving businesses exposed to penalties and reputational risks.
If a contractor fails to follow labour laws or pay their workers properly, how can that legally affect the hotel they work for?
The authorities can hold the hotel liable as the principal employer under the Contract Labour (Regulation and Abolition) Act, 1970 and the corresponding state rules. The Act places a statutory obligation on principal employers to ensure that contractors comply with all labour law requirements, and any failure by the contractor can be directly enforced against the principal employer, in this case, a hotel. If a contractor delays or defaults in paying wages, depositing PF or ESI contributions, or maintaining statutory registers, it can result in financial repercussions such as paying pending wages or social security dues on behalf of the contractor, as well as penalties for non-compliance. In some cases, especially those involving safety violations or repeated lapses, hotels can face prosecution, cancellation of licences or reputational damage. Worker grievances may also escalate into disputes, protests or negative press, all of which affect guest experience and brand trust. Even if the contractor is solely at fault, the hotel does not escape liability under the law.
Many hotels still use manual paperwork to track vendor compliance. Why is this approach risky in today’s environment?
